La continuidad del funcionamiento de la playa para acopio de arenas de la firma ABC S.R.L. es una incógnita, al descubrirse que uno de los permisos para la habilitación contiene errores de localización. El sitio donde instalaron el comercio de áridos está a la vera del arroyo Garupá y es un terreno que le pertenece al Estado nacional.
Los trámites para la habilitación del lote para acopiar y luego vender arena en la misma locación comenzaron en noviembre de 2019.
El punto de partida fue un documento emanado por la Dirección General de Puertos y Vías Navegables de Misiones, que lleva la firma de su director, Carlos Losada. En el instrumento legal se resuelve: “Declarar la habilitación técnica de la obra que la firma ABC S.R.L. ha finalizado los trabajos de construcción de una pileta para acopio y venta de arena fina, mediana y gruesa ubicada en la zona de la localidad de Garupá, Misiones”.
En el mismo artículo 1 de la resolución se especifica que el terreno se encuentra “en la margen izquierda del río Paraná”, como desconociendo que la zona a la que se hace referencia está ubicada, en realidad, sobre el arroyo Garupá, a unos 300 metros del lecho del río y a unos 500 del trazado actual de la ruta nacional 12.
El mismo párrafo del documento oficial finaliza con datos para la ubicación satelital exacta del predio, aunque, sin embargo, estos no coinciden con la zona en cuestión.
Con el permiso de la Dirección de Puertos en la mano, los responsables de la firma obtuvieron las autorizaciones de la dirección de Minas y Geología, dependiente del Ministerio de Industria -por entonces a cargo de Luis Lichowski-, de la Municipalidad de Garupá y de la Prefectura Naval Argentina (PNA), a quienes les fue remitido el visto bueno que carga con errores de geolocalización.
En la Muni, todo ok
En una nota firmada por el intendente Luis Armando Ripoll, con fecha 6 de noviembre de 2019, la Municipalidad de Garupá le responde de manera positiva a un pedido del titular de la firma ABC S.R.L., Carlos Gregorio Pasiecnik.
Como si se tratara de un terreno propiedad del municipio y en disponibilidad para habilitar un negocio privado, Ripoll resolvió otorgar: “Ante la solicitud del predio en cuestión, sobre el antiguo trazado de la ruta nacional 12, es factible sobre el terreno rectangular de 50 x 30 metros…”.
Si bien la empresa solicitó el lugar por el término de una década, el jefe comunal aclaró que es “imposible afectarla a diez años ya que el predio se encuentra afectado al proyecto de traslado del Anfiteatro Andrés Guacurarí, pendiente como obra complementaria de la Entidad Binacional Yacyretá (EBY)”.
Una vez legalizado el negocio para el acopio y venta de arena, la empresa ABC comenzó a operar sin descanso en terreno habilitado por el municipio de Garupá a través de la utilización de distintos barcos que operan en varias de las empresas extractivas de la tierra colorada.
Terrenos de la Nación
Alertados por el error inicial en el permiso otorgado por la Dirección de Puertos de la provincia, La Voz de Misiones buscó conocer quién tiene la titularidad del terreno en disputa.
Fuentes de la Dirección Nacional de Vialidad (DNV), en cuyo poder debería estar el terreno en cuestión, ya que se ubica donde está el trazado la vieja ruta 12 hasta que se sumerge en el arroyo Garupá, informaron que desde el organismo nacional llegaron a intimar a la firma ABC S.R.L., aunque en la última semana dieron marcha atrás, con lo cual el reclamo legal quedó sin efecto.
Entonces, LVM buscó respuestas en la EBY, desde donde confirmaron que toda la zona costera en cuestión es parte de un ambicioso proyecto de Costanera que incluirá el Anfiteatro Andrés Guacurarí.
La misma fuente de la entidad afirmó que buscan de manera incesante terminar con la ocupación comercial del predio para iniciar las obras que modificarán definitivamente la fachada de la intersección del arroyo Garupá y el río Paraná.
Sobre el terreno específico que ocupa la arenera ABC, todo indicaría que formaría parte de los bienes bajo la órbita de la Agencia de Administración de Bienes del Estado. Las fuentes consultadas aseguran que el único trámite administrativo posible para otorgar el lote a la provincia de Misiones es un decreto presidencial, medida que hasta el momento no ha sido efectuada.
Mientras tanto, la arenera continúa comercializando en el lugar, absolutamente legalizada, probablemente sin que nadie conozca el error inicial que le permitió existir en un lugar donde no puede funcionar.
